Guidance for Law Enforcement

Immigration Issues and Law Enforcement

The Attorney General’s office has issued updated guidance to law enforcement agencies to provide an overview of Illinois laws that govern law enforcement interactions with immigrant communities. The TRUST Act generally prohibits local law enforcement in Illinois from participating in immigration enforcement. The VOICES Act provides procedural protections for immigrants victimized by violent crime or human trafficking who have assisted law enforcement in investigating or prosecuting certain types of crimes.

In 2021 the Way Forward Act included reporting requirements for law enforcement state, county and local law enforcement agencies in Illinois to submit annual reports to the Attorney General’s Office regarding their compliance with the TRUST Act and the VOICES Act.

Responding to Sexual Assault

Improving the response of the criminal justice system to victims of sexual assault and sexual abuse is critical for the successful identification and prosecution of sexual predators and to prevent offenders from reentering our communities to commit new crimes.

The Sexual Assault Incident Procedure Act contains new requirements for law enforcement authorities and hospitals to improve their response to victims.
